Agreement between CATHY DRUMMONDS, hereinafter referred to as “SELLER”
and ____________________________________________________________________________________________________________________________ hereinafter referred to as “PURCHASER”.
Whereas, SELLER wishes to sell a “FEMALE” (AKC#_______________________________________________________________________) Old English Sheepdog from the litter
SIRED by: ___________________________________________________________________________________________________________________________________________________________________
and the DAM being: _______________________________________________________________________________________________________________________________________________________
Therefore, in consideration of the mutual promises herein stated, SELLER hereby sells to PURCHASER the dog on the following terms and conditions:
1. The purchase price will be $____________________.
2. SELLER will Co-Own the dog with PURCHASER. THE SHOW DOG CANNOT BE SPAYED. If the SHOW DOG is spayed without the consent of SELLER, PURCHASER will pay SELLER the sum of FIVE THOUSAND DOLLARS ($5,000.00) in damages to the future breeding program of “KEN-BEAR’S OLD ENGLISH SHEEPDOGS”.
3. The kennel name of “KEN-BEAR’S” must be placed at the beginning of the dogs’ A.K.C. registered name. SELLER must approve the dogs’ A.K.C. registered name before the dog is registered with THE AMERICAN KENNEL CLUB. A copy of the dogs’ A.K.C. papers will be given to PURCHASER when SELLER receives them.
4. SELLER will determine if the dog is show quality. The show quality dog must be shown to the completion of its championship. PURCHASER will pay dog show entries. SELLER agrees to Handle and Groom the dog at no cost to PURCHASER while the dog is being shown. PURCHASER agrees to bring the dog to SELLER once a week for grooming unless PURCHASER can maintain the coat for showing; then PURCHASER is only required to bring the dog for grooming at SELLERS request. PURCHASER will bring the dog to SELLER for showing at SELLERS request.
5. PURCHASER agrees to have the dog certified and pay for the following: HIPS, ELBOWS, EYES, THYROID, HEART WITH DOPLAR, PCD-PRIMARY CILIARY DYSKINESIA/CA-CEREBELLAR DEGENERATION/DM-DEGENETIVE MYOPATHY, and EIC-EXERCISE INDUCED COLLAPSE by the age of 26 months. Cost of testing is approximately between $1000.00 to $1500.00. A copy of all certifications must be given to SELLER when PURCHASER receives them.
6. PURCHASER agrees to breed one (1) litter. SELLER will pick the stud dog. If PURCHASER raises the litter, PURCHASER agrees to follow all instructions given by SELLER, pay the stud fee, and all expenses incurred by the litter of puppies. From this breeding SELLER will have first pick of two (2) puppies (free of charge). The remaining puppies belong to PURCHASER and SELLER will help sell remaining puppies. If SELLER raises the litter then all expenses incurred by the litter of puppies and stud fee is SELLERS’ responsibility. From this litter PURCHASER will have first pick [one (1)] of companion puppies after show prospects have been set aside (free of charge) or the price of one (1) puppy. PURCHASER also has option to take pick puppy of litter if they agree to sign another show contract with SELLER.
7. In the event the dog does not certify in all nine (9) certifications listed in line 5, it cannot be used for breeding and will then be considered useful for pet or showing only. PURCHASER agrees to have the dog spayed at their expense and a copy of verification from the Veterinarian given to SELLER.
8. If at anytime PURCHASER is unable to keep or refuses to allow SELLER to exercise the conditions of this contract, PURCHASER forfeits all rights to the dog. Arrangements will be made by SELLER for the return of the dog and its’ papers signing ownership back to SELLER. In this event, NO MONEY WILL BE REFUNDED TO THE PURCHASER. If PURCHASER refuses to return the dog or show the dog and SELLER is forced to take legal action then PURCHASER will be responsible for all court and legal fees incurred by SELLER.

THIS ANIMAL IS GUARANTEED AS FOLLOWS:
SELLER guarantees this dog against any health or temperament irregularities at the time of sale. PURCHASER agrees to take the dog to a licensed Veterinarian of their choice within 48 hours of purchase for a health check. A full refund will be given if found unsatisfactory by Veterinarian exam upon presentation of a written diagnosis from said Veterinarian to SELLER. IN ADDITION, if the dog should develop a major communicable disease (i.e. distemper, leptospirosis, hepatitis) within seven (7) days from the date of purchase, SELLER must be notified immediately and will provide instructions for refund as specified above. Hip guarantee: X-ray must be done by 26 months of age. No guarantee past 26 months. X-ray of hips must be sent to the Orthopedic Foundation of America for evaluation; in the event the dog comes back showing hip dysplasia the following refund will be made by SELLER: Mild Dysplasia--No refund; Moderate Dysplasia--$200.00 refund; Severe Dysplasia--$400.00 refund. No other guarantee is given except in the case of a hereditary defect, which develops to the extent that it renders the dog unsuitable as a pet within one (1) year from the date of sale. In this instance, a replacement will be given as soon as one becomes available. If for any reason, PURCHASER decides they can no longer care for the dog, the dog must be returned to SELLER with its’ papers signing ownership back to SELLER. SELLER will be responsible for finding the dog a new home. In this event, NO MONEY WILL BE REFUNDED TO PURCHASER.

PURCHASER agrees to have the dog neutered at PURCHASERS expense and a copy of verification from the Veterinarian given to SELLER.
